Data Sovereignty<\/span><\/span>\u00a0<\/span><\/span><\/h2>\n

To honor data sovereignty<\/a><\/span><\/span>,<\/span><\/span> tribes need to be involved <\/span>in the decisions to collect, use, and <\/span>disseminate<\/span> any data on tribal members <\/span>before data <\/span>are<\/span> collected.<\/span><\/span><\/span><\/p>\n

Data on tribal members are already collected by non-tribal public health entities (such as state and local health departments).<\/span> <\/span>For the purposes of this toolkit, th<\/span>ese<\/span> data are referred to as \u201cTribal data<\/span>\u201d.<\/span> <\/span>Tribes have a special interest in this data and <\/span>have <\/span>particular rights to control the collection and use of this data<\/span>.<\/span> <\/span>This is <\/span>not,<\/span> however, the only data Tribes are able to receive for public health purposes. <\/span><\/span>Tribes and TECs are able to receive any data they deem necessary to perform their public health functions \u2013 not only \u201cTribal data\u201d<\/span><\/span><\/span><\/a>. In other words, Tribes and TECs can receive data for non-Tribal members and for people living off the reservation if they believe it is necessary to perform their public health functions<\/span>.<\/span><\/span>\u00a0<\/span><\/span><\/p>\n

One of the biggest challenges when discussing the collection and use of Tribal <\/span>data <\/span>are<\/span> what constitutes \u201cTribal data<\/span>\u201d.<\/span> In the broadest sense, Tribal <\/span>data are<\/span> data or information on members of a specific Tribe or that describes a specific Tribe<\/span><\/span>.<\/span><\/span>\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n

As noted <\/span>earlier<\/span>, <\/span>AI<\/span>\/AN race as collected by health departments is not always the same as Tribal members. People who identify as AI\/AN can be Tribal members, but they may not be. They could also live on Tribal lands of one Tribe but be members of a different Tribe. <\/span><\/span>It can be difficult \u2013 or impossible \u2013 for non-Tribal public health entities to accurately <\/span>identify<\/span> Tribal members.<\/span><\/span>\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n
