Indigenous Data Sovereignty<\/span><\/span><\/span><\/a><\/span><\/h2>\n

\u201cThe right of each tribe to govern the collection, ownership, and application of data, information, and knowledge about its peoples, lands, and resources. Indigenous data sovereignty derives from the inherent right of Native nations to govern their peoples, lands, and resources, which is acknowledged in treaties and other legal mechanisms negotiated on a nation-to-nation basis with settler-colonial governments<\/span>.<\/span>\u201d<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n

Tribes are sovereign nations <\/span><\/span>and o<\/span>ne of the many ways that Tribes have the right to exercise their sovereignty is with respect to data.<\/span><\/span>\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/strong><\/p>\n

Indigenous (or Tribal) data sovereignty means that tribes have a right to control the collection, ownership, and use of their own data<\/span><\/span><\/span><\/a>.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n

When working with Tribes on public health issues, it is important to remember that Tribes should be able to control data on their members \u2013 regardless of who currently holds the data.<\/span><\/span>\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n

Federal, state, and local <\/span>jurisdictions<\/span> should integrate <\/span>I<\/span>ndigenous <\/span>D<\/span>ata <\/span>S<\/span>overeignty into their laws, policies, and relationships with tribes.<\/span><\/span>\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n

<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n

For data<\/span> sovereignty to be meaningful<\/span>, it<\/span> must be addressed before <\/span>data <\/span>are<\/span> collected.<\/span> <\/span><\/span>Most <\/span>jurisdictions<\/span> have not done this.<\/span><\/span> States collect data without explicit permission from Tribes.<\/span><\/span>\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/strong><\/p>\n

There are technical challenges to <\/span>identifying<\/span> tribal members in data and to coordinating with multiple <\/span>T<\/span>ribes.<\/span><\/span>\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n

However, states should involve Tribes in the decision-making process <\/span>regarding<\/span> the collection and use of data, including how to <\/span>identify<\/span> Tribal members.<\/span><\/span>\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n

At a minimum, Tribes should be consulted in the development of data collection and use practices in the health department and any data collected that is needed by Tribes to perform their public health obligations should be provided to them.<\/span><\/span>\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n

Tribes may also have processes for collecting their own data and honoring Native data practices and wisdom outside of the United States public health system.<\/span><\/span>\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n

The term \u201cTribal data\u201d <\/span>generally refers<\/span> to data on specific tribal members or data that is representative of a Tribe or Tribes. For example, the COVID-19 test positivity rate for a specific Tribe could be considered \u201cTribal data\u201d<\/span>.\u00a0 <\/span>Because of Indigenous Data Sovereignty, Tribes should control this data.<\/span><\/span>\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n

\u201cTribal data\u201d is not, generally, the only data <\/span>T<\/span>ribes need to perform their public health obligations.\u00a0<\/span><\/span>\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n
